How Does Maryland Law Define Personal Injury?

As defined by Maryland law, what is personal injury?

Personal injury cases are part of the larger body of law called torts. A tort is any kind of injury to a person’s body or mind. This may include and is not limited to physical injuries, broken bones, soft tissue injuries, connective tissue injuries, spinal cord injuries. It could be psychological injuries, pain and suffering, anguish, or fear.

There can be many categories of injuries that don’t involve actual physical injuries. These are injuries which allow a person to receive monetary compensation. The person that committed the wrongful action is also called a tortfeasor. Torts may result from intentional actions such as assault and batteries, or negligent actions like texting while driving.

Negligence Defined

Negligence is inaction that accidentally injures someone. In a negligence case (such as a personal injury case that my firm would handle), the plaintiff claims that the defendant did not do something that he or she should have done or failed to do something that they should have done.

While the list of examples can go on and on, the most common is a property owner failing to provide minimum requirements established in the contract needed daily. This could be a simple as not providing adequate lighting. Another very common act of negligence is a driver failing to pay attention to the road resulting in an automobile accident. The most common is due to tail gating.

While there are numerous ways to suffer from an injury through negligence, the important thing is to seek medical attention if needed as well as to understand your rights and how you can protect them.
